Building situations

Exterior and common areas

Stairs, balconies, railings, trim, fences and breezeways are what an inspector can see from outside, and a pre-1978 building may carry old paint on every one. Scraping failing paint there is renovation work when someone is paid, and containment keeps chips off walkways and out of planters.

Turnover and unit repairs

A landlord who pays someone to patch, sand or repaint between tenants is commissioning EPA renovation work in any pre-1978 unit; the EPA lists owners and managers as covered parties. Expect an EPA-certified firm with a certified renovator. Anything under 6 square feet in a room, or 20 outdoors, is a minor repair.

Disclosure to tenants and buyers

What does an owner of a pre-1978 building have to hand over? At a sale or lease, the EPA pamphlet and the Lead Warning Statement, plus the owner’s account of any known lead paint; records stay on file for three years. CDPH adds that amending a lease starts the clock again. Short leases of 100 days or less, units without a bedroom and buildings an inspector certified lead-free are exempt.

Federally assisted buildings

Housing with federal assistance may fall under HUD’s Lead Safe Housing Rule, and what it requires depends on the kind of assistance. Ask whoever administers your assistance which parts apply to the building.

The Concord inspection program

Ordinance 00-2, adopted March 7, 2000, created Concord’s Multi-Family Rental Housing Inspection Program for rental buildings with four or more units on a parcel, including fences, walls and accessory structures. A city building inspector reviews units and common areas every two years against the building and housing codes and the code’s exterior and site maintenance standards. The program’s page does not mention lead, so an inspection is not a lead test.

County resources for owners

CDPH’s county directory lists a Childhood Lead Poisoning Prevention Program operated by Contra Costa County Public Health, at (925) 608-5318. Ask the county whether any help for lead repairs in rental buildings applies to you; no funding is promised here.

What affects the cost

The number of buildings and units, how much of the work is outdoors, whether tenants stay in place, and whether the plan is testing, interim controls or permanent abatement all shape the scope. Phasing around occupied units adds scheduling and notice steps.

Turnover repairs are the business of lead-safe renovation and remodeling. Whether a certified inspection can prove units lead-free is explained in lead paint inspection and testing. Concord Lead Paint Removal links everything else.
